1. About MesaAlert
MesaAlert ("we", "us", "our") is a restaurant table alert and management software-as-a-service operated by Felix Moran, a sole proprietor based in Utah, United States. MesaAlert provides restaurants with real-time customer alert systems, floor map management, waitlist management, reservation handling, and related features accessible via web browser.
2. Acceptance of Terms
By registering for an account, accessing, or using MesaAlert in any way, you ("Customer", "you") agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use MesaAlert. If you are using MesaAlert on behalf of a business, you represent that you have the authority to bind that business to these terms.
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use MesaAlert. MesaAlert is intended for business use by restaurant operators and their staff.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials (tenant ID, PIN, API keys). You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information when registering and to keep this information updated. Accounts created with false information may be terminated.
4. Free Trial
MesaAlert offers a free trial period of 10 days from the date of account creation. No credit card is required to start the trial. At the end of the trial period, your account will be paused. Your data will be preserved for 30 days after the trial ends. To continue using MesaAlert, you must subscribe to a paid plan.
5. Paid Plans and Billing
5.1 Plans
MesaAlert offers the following subscription plans:
- Starter — $29/month: Up to 15 tables, alerts, QR codes, waitlist, reservations
- Pro — $49/month: Up to 50 tables, waiter app (up to 5 waiters), Station Mode
- Enterprise — $99/month: Unlimited tables, waiter app (up to 10 waiters), Station Mode
5.2 Billing Cycle
Subscriptions are billed monthly on the anniversary date of your subscription start. All prices are in US Dollars (USD) and do not include applicable taxes.
5.3 Payment Processing
Payments are processed securely by Stripe, Inc. MesaAlert does not store your credit card information. By providing payment information, you authorize us to charge your payment method for the applicable subscription fee on a recurring monthly basis until you cancel.
5.4 Failed Payments
If a payment fails, we will attempt to retry the charge. If payment is not resolved within 7 days, your account may be suspended until payment is received.
5.5 Plan Changes
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the next billing cycle.
6. Cancellation
You may cancel your subscription at any time by contacting us at [email protected] or through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. After cancellation, your account data will be preserved for 30 days before permanent deletion.
7. Acceptable Use
You agree to use MesaAlert only for lawful purposes. You may not:
- Use the service for any illegal activity
- Attempt to hack, reverse-engineer, or compromise MesaAlert's systems
- Use the service to send spam or unsolicited communications
- Resell or sublicense access to MesaAlert without written permission
- Overload our infrastructure with excessive automated requests
- Impersonate MesaAlert or its representatives
8. Service Availability
We strive to maintain high availability of MesaAlert but do not guarantee 100% uptime. MesaAlert is provided "as is" and may be subject to scheduled or unscheduled maintenance, updates, or outages. We will make reasonable efforts to notify customers of planned downtime in advance.
9. Limitation of Liability
Important: To the maximum extent permitted by applicable law, MesaAlert and Felix Moran shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of business, or any damages resulting from system downtime, failed alerts, or service interruptions — even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising under these terms shall not exceed the amount you paid to MesaAlert in the 3 months preceding the claim.
10. Intellectual Property
MesaAlert and all its components — including the software, dashboard, customer page templates, QR system, and associated technology — are the intellectual property of Felix Moran. You are granted a limited, non-exclusive, non-transferable license to use MesaAlert during your active subscription. You may not copy, modify, distribute, or create derivative works based on MesaAlert without written permission.
11. Customer Data
You retain ownership of all data you input into MesaAlert (restaurant information, customer emails, reservation data, etc.). By using MesaAlert, you grant us a limited license to process this data to provide the service. We will not sell your data to third parties. See our Privacy Policy for full details on how we handle data.
12. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service, fail to pay applicable fees, or engage in activity that damages MesaAlert or its users. You may terminate your account at any time as described in Section 6. Upon termination, your right to use the service ceases immediately.
13. Changes to Terms
We may update these Terms of Service from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of MesaAlert after the effective date of changes constitutes acceptance of the new terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Utah County, Utah.

We automatically collect information about how you use MesaAlert:
- Table open/close events and timestamps
- Alert events (type, table number, time)

- IP address and approximate location
- Pages visited within the dashboard
2.3 Customer Data (Your Customers)
MesaAlert may collect the following data from your restaurant's customers through QR code interactions:
- Email addresses (if provided voluntarily for marketing purposes)
- Star ratings and review comments
- Table number and session timestamp
- Type of service requested (assistance, check, cleaning)
You, as the restaurant operator, are responsible for informing your customers about this data collection and obtaining any required consents under applicable law.
2.4 Reservation Data
If you use the reservation webhook feature on your website, we collect reservation form submissions including: customer name, phone, email, date, time, party size, and notes.

We use the collected information to:
- Provide and operate the MesaAlert service
- Process payments and manage subscriptions
- Send service-related notifications and alerts
- Send email campaigns on your behalf (Marketing feature)
- Improve and develop new features
- Respond to customer support requests
- Detect and prevent fraud or abuse
- Comply with legal obligations
We do not sell your data or your customers' data to third parties for advertising purposes.
4. Third-Party Services
MesaAlert uses the following third-party services that may process your data:

5. Data Storage and Security
Your data is stored on Cloudflare's infrastructure, which is distributed across multiple data centers globally. We implement reasonable security measures including:
- HTTPS encryption for all data in transit
- PIN-protected access to sensitive dashboard areas
- Tenant isolation (your data is separated from other customers)
- Regular security updates to our systems
However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.
6. Data Retention
- Active account data: retained while your subscription is active
- After trial expiration or cancellation: data preserved for 30 days, then permanently deleted
- Payment records: retained for 7 years as required by US tax law
- Customer emails captured through QR sessions: retained until you delete them from your dashboard

- Correction: Request correction of inaccurate data
- Deletion: Request deletion of your account and data
- Portability: Request your data in a portable format

10. Children's Privacy
MesaAlert is not directed at children under 13 years of age and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us immediately.

1. Free Trial
MesaAlert offers a 10-day free trial with no credit card required. The trial includes full access to all features of the Starter plan. We strongly encourage you to thoroughly test MesaAlert during this period before subscribing.
2. No Refund Policy
All subscription payments are final and non-refundable. By subscribing to a paid plan, you acknowledge and agree that:
- No refunds will be issued for any reason, including but not limited to dissatisfaction with the service, failure to use the service, or changes in your business needs
- We do not provide partial month refunds
- Downgrades or cancellations do not entitle you to a refund for the current billing period
We encourage you to make full use of the 10-day free trial to ensure MesaAlert meets your needs before subscribing.
3. Cancellation
You may cancel your subscription at any time by contacting us at [email protected]. Upon cancellation:
- Your subscription remains active until the end of the current billing period
- You will not be charged for subsequent months
- Your data will be preserved for 30 days after the subscription ends, then permanently deleted
4. Service Credits
In the event of significant service interruptions directly caused by MesaAlert (more than 24 consecutive hours of complete service unavailability), we may, at our sole discretion, issue account credits toward future subscription months. Credits are not cash refunds and have no monetary value outside of MesaAlert.
